A Release in ffee
and covenant 7 February1715/6, (2 George I)
indorsed "A Release in ffee
and covenant to suffer a common Recovery from Mr Anthony Hammond to Mr Gabriel
Neve and Mr John Smalley".
Parties – Anthony Hammond of St Albans, Nonnington, Kent, gentleman, only
sonne and heire of William Hammond of St Albans aforesaid, Esquire, by Elizabeth
his late wife being Elizabeth Kingsford (1) and Gabriel Neve of London,
gentleman (2) and John Smalley of London, Merchant (3).
Reciting that said William Hammond being seised for life of the Mannor, messuage,
lands, etc. hereinafter mentioned the immediate reversion or remainder whereof
belongs to said Anthony Hammond and the heirs male of his body issuing did by
Indenture of 4 February instant for the perfecting of some assurance then
shortly to be made of the said presents by way of common recovery, grant and
surrender to said Anthony Hammond the said Mannor, messuage etc. hereinafter
mentioned
To hold to said Anthony Hammond and his heirs for ever upon condition that if
the said Anthony Hammond did not pay to the said William Hammond £8000 on 25th
June next the said assurance should become void.
Consideration 10/- paid by Gabriel Neve to Anthony Hammond for the cutting of
barring and docking all entails, remainders and reversions and for the conveying
and settling of a good estate of inheritance in fee simple upon the said Anthony
Hammond, his heirs and assigns, he said Anthony Hammond granted and bargained
and sold and released to said Gabriel Neve he being in actual possession by
virtue of an Indenture of bargain and sale dated the day before these presents
Parcels – All that mannor or lordship of Eastwall alias Easole alias St Albans
with the rights, members and appurtenances thereof situate in the parish of
Nonnington and Wymingswold, Kent, or either of them in the County of Kent and
all other the lands, tenements and hereditaments of said Anthony Hammond within
the parishes of Nonnington, Goodnestone and Wymingswold.
And all that messuage or tenement commonly called Chillendon Court Lodge and all
buildings, etc, containing by estimation 120 acres situate in the parishes of
Chillendon, Goodneston, Northborne and Nonnington, Kent, heretofore in the
occupation of Matthew Browning and now of John Sole.
And all that piece of wood ground called Pinners Wood containing in all by
estimation 10 acres situate in Nonnington parish in the mannor of St Albans in
the occupation of the said William Hammond.
And also all those 18 acres of marshland lying and being in Ash.
Habendum to Gabriel Neve to make him tenant that a writ of entry sur Disseizen
in le post may be brought and a recovery had against him by the said John
Smalley who shall vouch to warranty the said Anthony Hammond who shall appear
and vouch to warranty the common vouchee.
Said John Smalley shall stand seised to the use of said William Hammond for his
life and then to use of Anthony Hammond, his heirs and assigns for ever.
