The Monumental Inscriptions (M.I.s) in the and churchyard of the St Mary the Virgin Church, Upchurch

St. Mary the Virgin is notable for it's eccentric spire, it has a spacious interior but has only a few monuments inside the church. The finest one is from the 14th century but has no surviving inscription. The churchyard is large on the north side with a modern extension to the north west which was not included in this record. I am grateful for the work of the late Reverend Chare, who transcribed the churchyard monumental inscriptions in 1978, this remains as a typescript and was never published. Most of the transcriptions are very accurate, with few mistakes, although he did not generally follow the original layout. It is important for recording monuments I did not find or have deteriorated badly in the last 42 years, an extraordinary measure of modern pollution. Although Rev Chare transcribed 112 monuments, according to his plan, the typescript only goes to 100, so any after 100, which are now missing or illegible seem lost.
   I very much appreciate the help of Mr and Mrs Osborne. Mrs Helen Osborne was very informative regarding the parish and church history and her coffee and biscuits were very welcome !
   The oldest monuments in the churchyard are clustered in the south east section and east of the chancel. There are interesting and informative photographs of the church and village, with an excellent brief introduction by Helen Osborne in Upchurch in old picture postcards by Mike Gunnill, 2004.
   I have included all related wills I could find, pre 1858, (mostly Archdeaconry Court of Canterbury wills, proved by the Vicar, with a few proved in London at the Prerogative Court of Canterbury). These I have summed up in a concise form, I have included a few from after 1858, (when probate moved from the Church of England to a new secular arrangement). But I have also included the Index notes to all the remaining post 1858 wills, copies of the wills can be ordered online from Find a Will.Gov .
   Finally, my thanks to my wife, Beverley for her invaluable assistance, to Ted Connell for hosting this record and compiling the index, and the staff of the County Archives at Maidstone for their friendly and ever professional help.

   He is sick and weak in body.
   To his wife Mary, for ever, all his marsh land called North Marsh, with the house bought from the co-heirs of Zachery Kingsford in Gillingham. Also to his wife, the rest and residue of the term of years in the lease of the Parsonage of Upchurch, which he holds from All Souls College; also the lease for the farm house and lands called Obery Farm, (Upberry) in Gillingham, where he now lives.
   All his ready money, invested money, debts, credits, plate, corn, stock, horses, colts, cows, sheep, hay, plough tackle, wagons, carts, goods, cattle, chattels and personal estate, after his debts, funeral and probate costs are paid, to his wife, Mary, for ever. She is sole executor.
   Witnesses: Richard Glover, John Down and Thomas Johnson.
   Proved 8th of June 1720

As far as I can tell there seems to be no further inscription for Mary Essex on her husband's ledger. Perhaps there is a separate ledger beneath the organ? Or the inscription for her may be of lesser width than her husband's and does not reach the northern edge of the stone? There is a black ledger, probably from later in the 18th century or 19th century under the choir stalls and organ, one line seems to contain the word Maid[stone]?

   She is sick and weak.
   To her nephew, William Young*, son of her brother Edward Young, her real and personal estate, debts, stock, household goods, leases, corn and cattle and personal estate, her debts and funeral costs being first paid.
   She appoints William Young her sole executor.
   Witnesses: Francis Brett, Jacob Cazeneuve and Francis Brooke

   He is weak in body.
   He wishes to be buried in the South Chancel at Upchurch.
   To the poor of Upchurch, 20 shillings, to be distributed by the Churchwardens a fortnight after his burial.
   To his son Richard , all his goods and chattels, corn, cattle at Horsham Farm, which is also bequeathed to Richard.
   To son Thomas, his goods, corn and cattle at Gore Farm, which is bequeathed to Thomas.
   Also to son Richard,    ?    my sloth?,  of    ?    upon a piece of ground called Norwood ? Also all other goods not given before.
   His lands and houses in Upchurch, to son, Richard, a house occupied by Robert Pannet, a house called Brooke occupied by Passon, another house at Brooke Forstall occupied by Andrew Brameres?
   To son Thomas, a house and land occupied by Thomas Pett.
   If son Richard dies before he is 21, then his legacy to his brother Thomas.
   If Thomas dies before he is 21, then his legacy to his brother Richard.
   If they both died under 21, then then their legacies to his brother (in law ?) William Peerce of North Chappell? Surrey.
   Son Richard is his sole executor, he to pay all his father's debts and funeral costs.
   His well beloved friends, Mr John Wit???vy of Newington and Thomas Smith of Rainham to take custody of the goods and chattels given to son Thomas until he is 21 and to see he is taught to read and write and to take rents and profits from real estate for his sons' maintenance while minors.
   Witnesses: Christopher Collard and the mark of Richard Polley
   Proved 9th February 1637 (1638)

Grennell's son, also John, seems to have died just before his father, who he mentions in his will. There is no sign of a monument to him in the church but there probably was one in the churchyard, which has since perished. The Grinells, father and son, died closed to each other in the Winter of 1637-38 and their wills were proved on the same day. This seems to have caused some confusion, which has lasted to the present, the Canterbury Probate Index does not make it clear that there is a will for the senior Grinnnell. See Appendix for John Grinnell, Junior's will and list of documents I had not obtained before the current library closures.

Prerogative Court of Canterbury Will Dated 13th April 1847
John Walter of Upchurch, Gentleman.
   He appoints William Walter of Tutham, West Farleigh, Gentleman, William Walter of Rainham, Gentleman and John Benjamin Andrews of Hartlip, Gentleman, executors and trustees.
   His freehold farm and and in Ruckinge and Queston?, of about 50 acres, occupied by William Hawland to his trustees, upon trust. The yearly rents and profits for the benefit of his Son, John Walter during his lifetime. Trustees have the power, during his son's lifetime, in their discretion to manage the farm and let it for a term not exceeding 7? years. After his son's death continuing in trust for the child or children of son John. The rent towards their maintenance, while they are minors. The surplus to be accumulated by trustees for benefit of Trustees can mortgage the property up to ¼ of it's value and use the money raised for the benefit of son John.
   In case there is no child or children of son, John living at the time of his death, then the farm and lands to the benefit of his sons, Frank, Walter and Stephen Vesey Walter, as tenants in common.
   To his trustees his property called Bridge House , lands and cottage at Marden, occupied by Mr Robert Perry and Mrs Mary Walter and his other freehold cottages in Marden, occupied by Frances Andrews and [         ] Hunt and all other freehold houses , lands and real estate, upon trust to, as conveniently after his death, sell and dispose of. The net amount raised to enter into his residuary personal estate.
   To his trustees his ready money, securities for money, goods, chattels, credits and residuary personal estate and effects, upon trust, to sell that not consisting of money or securities. Trustees to continue the business at Gore Farm in Upchurch. If son Stephen Vesey Walter is 21 at testator's death, he can purchase at term of valuation arrived at of all or any part of the business he carries on. If he declines to do so, then the business to be discontinued at first opportunity, the effects and stock to be sold. Trustees to be possessed of the proceeds and his personal estate and effects, upon trust, to pay is debts, funeral and probate costs and expenses relating to the trust, legacies and surplus to his residuary personal estate.
   To son, Frank Walter, £2,000 and no more because he has already paid at great expense for his education; to son, Stephen Vesey Walter , £2,500.
   From the residue of his personal estate, a third to son Frank, a third to son Stephen Vesey; the remaining third, upon trust, and from time to time all or part used for the personal , maintenance of son John, as they think fit.
Trustees can invest surplus funds in Government Securities. A quarter of his residuary personal estate can be used for son John's advantage.
   Witnesses: Eliza Whitmore Monckton, Maidstone, William Tew?, Clerk to Mr Monckton, Solicitor, Maidstone

The father of the Walter brothers and sister listed on this ledger, was John Amhurst Walter. The Walter family had lived in Marden for many centuries, with numerous monuments in the church and churchyard. John Amhurst Walter is buried inside the parish church.

He left a Prerogative Court of Canterbury will, dated 18th January 1825.
He was then still of Upchurch and a Gentleman.
   He appointed brother Stephen and son in law John Walter, (husband of Mary Walter, probably cousins), executors and trustees.
   To them upon trust, the Parsonage of Marden with glebeland, a third of tithes, corn, grain, hay, plantations and fruit; freehold houses and buildings and farms at Upchurch and Marden, to sell.
   Also to executors, his ready money, securities for money, goods, chattels, plate, linen, china, effects and personal estate, after payment of his debts, funeral and probate costs, upon trust.
   Executors to carry on his farming business at Gore Farm and Borden Parsonage or Hall, for one year from the next Michaelmass after his death. They to collect debts owing to him and sell that of his personal estate not consisting of money, for the benefit of his children, Elizabeth Walter, Mary, wife of John Walter, Edward Walter, John James Walter, Stephen Walter, William Walter,   ?   Walter and George Walter, equally shared when they are 21 years old. While they are minors, interest from the fund towards their maintenance and education.
   Executors to allow sons, Edward and William jointly or singly, if one declines, use of Gore Farm and Borden, with live and dead stock, they to pay value of the latter , valued by two persons chosen by the executors and two chosen by his sons.
   To sons, Edward and John James, houses, lands and leaseholds vested in him as trustee or by mortgage.
   Witnesses: Stephen Tucker of Borden, Gostwyck Prideax, Curate of Upchurch and Mary Murton, daughter of George Murton of Rainham.

Codicil 31st October 1825
He is still of Upchurch. Executors and trustees to manage farms at Gore and Borden, until son George is 21. They will also pay yearly and every year while son, Edward is employed in the management of the farming business, £80, and to son William for his own use for every year he is employed in the business, £40 and additional sums if they think fit. Also for every year the business is carried on, they to pay towards the maintenance and education of son James, while a minor; the same applies for sons George, Edward and William and daughter, Elizabeth.
   The residue of rents and profits to be shared equally between his children. Soon after the youngest of his children is 21, or dies under that age, if trustees think it advisable not to carry on the farming business, then money from the sale to be equally shared by his children.
   Sons Edward and William, equally and jointly or if one declines , the other to have first offer of taking the several farms , before mentioned, paying for cattle, implements, chattels and effects, according to the valuation before mentioned, .
   If executors and trustees think fit, during the minorities of sons James and George, they can apply all or part of their respective share, to establish their place in a profession or otherwise for their advantage.
   He ratifies rest of the will.
   Witnesses: Mary Matson of Borden, George Dear Friend, Surgeon of Newington and Sarah Kitchingham, Servant to Mr Walter.
   Proved 5th May 1826

   To his wife Euphemia, his houses, gardens and land of about 7 acres in Upchurch and Lower Halstow, occupied by Thomas Barnes?, afterwards of his late father James Barley and lately by William Harris, Edward Taylor and himself and all other real estate, for ever. Also all his goods, chattels, rights, credits, money, securities for money, plate, china, linen, stock and crops, personal estate and effects, after payment of his debts, funeral and probate costs, to his wife, whom he appoints sole executor.
   Witnesses: Br[yan] Fausett, D. Fausett and Thomas Cantwell
   Proved 13th August 1821. Value of goods, chattels and credits less than £200. Note states that he died on the 12th June

Euphemia Barley, wife of the above remained his widow until her death in 1846, she was living in St Margaret's parish, Rochester, when she made her will, it does not mention Upchurch.
   The main legatees were, her niece, Eleanor Moore, Widow and Maria Turker , Widow, daughters of her late sister, Eleanor Presho?

   First, all his debts, funeral and probate costs to be paid.
   To his wife, Ann, £50 absolutely and, for life, all household furniture, plate, linen, books and china; she to have an inventory made and valuation and insure against fire.
   After her death, the above to be sold, and, any she did not retain. Proceeds to go into his residuary personal estate.
   To his wife and friend Joseph Young of Chatham, Grocer and son in law, Henry Pearson of Maidstone, Smith and Wheelwright, all his freehold and leasehold estate and his share in the same, also his ready money, securities for money, securities fir debts, personal estate and effects, upon trust. They to sell his business and stock in trade and effects and the proceeds to fall into his residuary personal estate.
   They to invest the money into good mortgage securities, upon further trust, to pay his wife the rents and profits from his real estate and the dividends of the trust estate, for life, she keeping the real estate insured.
   After his wife's death, the trustees to sell his real estate, (except a house or cottage and about 3 acres of land he purchased of Mr Vant in Lower Halstow, now occupied by himself, Mr Vant and [Henry?] South.    To his daughter, Mary Hadlow, now residing with him, and good friends, Benjamin Briggs of Chatham, Grocer and George Acworth of Chatham, Gentleman all his free and leasehold houses, lands, household goods, furniture, plate, linen, china, books, live and dead stock, debts, money and securities for money, his personal estate and effects, upon trust, to have inventories and valuations made of his live and dead stock and household contents to his wife, Mary for life if she chooses to manage his farm and lands or until his trustees consider it necessary to sell his farm, then the household contents not sold, to continue in his wife's custody. She to keep the property insured from fire and to keep in good order and condition.
   Trustees to allow his wife during her life, if she chooses to occupy, use and manage his farm and lands , without paying rent, to use the proceeds for herself and for the maintenance of their children who are living with her.
   If his wife chooses to discontinue the farm business, trustees to sell it and stock and end the tenancy of his wife. As long as the estate remains unsold, his wife to receive an annuity of £50 for life, from rents and profits of his estate. She to have so much of his furniture, plate and linen required for her comfort, for life.
   After her death, the estate to be divided equally between his children, both by his former wife and present one. If any of his children are dead, leaving lawful issue, their share to that child or children, at 21 years of age or day of marriage, if girls. During their minorities, trustees to use interest, dividends and annual produce to support and educate them and for their advancement.
   From the share of daughter Jane, one third to her daughter, Sarah Jane by her former husband, at 21 years of age or day of marriage, during her minority to be used as above.
   He has already advanced to son William, over £600; for the security of this sum, he holds the titles of an estate at Sheerness of three tenements or cottages. In case son William, within 12 months of his decease, pays the trustees £400, in full discharge of the debt, then he will be entitled to the above deeds and have a full share in the estate with his siblings. If he does not pay the £400, then his share to fall into testator's residuary personal estate.
   To the trustees, all property vested in him as trustee or mortgagee.
   Appoints trustees as executors.

Codicil 15th April 1845
He revokes appointment of Benjamin Briggs and George Acworth as trustees and executors and appoints in their place, his nephew, George Hadlow of Margate and William Brooke of Margate, Solicitor. His wife, Mary and daughter Mary Ann are also appointed to act with them.
   He revokes so much of his will referring to son William paying £400 for the deeds of the Sheerness properties. The properties have been disposed off to his great expense and inconvenience. If William pay £650, within 12 months after his death he will have an equal share of the estate but if he does not pay it his share to go into testator's residuary personal estate.
   To nephew, George Hadlow of Margate two pieces of ground with a plantations and cottages in Upchurch late in testator's father's occupation, now in his own, on condition that George cancels bonds by which he had advanced cash to testator to which his estate is liable.

The will of Edwin Mudge is dated 12th April 1855 and is very brief.
   He was a Carpenter and Smith and died in Luton (Chatham). His executors were his sons, William of Upchurch, Carpenter and James Daniel of Upchurch, Carpenter and Wheelwright. He rented his the site of his business from Mr Hilton but built the workshop and forge himself, which he leaves to his son, James Daniel, who is also left all tools and implements. He desires all debts owing to him be collected and that all wood and iron in his yard and household furniture and effects be sold. After the payment of his debts, funeral and probate, the proceeds be divided into five equal parts. One share to son William, one to daughter, Mildred, one to daughter, Mary, one to daughter, Elizabeth and one to the children of his late daughter, Ann Caroline.
   The will was signed on behalf of Mudge, who must have been too weak even to make his mark, by William Green .  Witnesses: Henry Mitchell and William Austin

Also upon condition, that the sons pay their mother, Elizabeth who is now pregnant, £8 per annum for the child she is carrying and for her while she remains his widow, if the child dies his wife to have £5 per annum, for life, for as long as she remains his widow.
   If his sons default, then his wife can distraint the property to obtain the money.
   If the child she is carrying is a male and shall attain the age of 14, he gives him £20 to put him apprentice to a good trade or business. If he lives to 21 years he gives him an extra £30 and £13 of the £30 during his apprenticeship.
   If his wife is carrying a female child, the child to have £50 at 21 years of age or day of marriage if earlier.
   His wife to have the use of his house, goods and linen until she gives birth and for one month after or until she is able to go out of the house.
   His son William who is his executor shall find out of his father's estate personal estate for his mother's and child or children, one month after the delivery, good and sufficient meat, drink, washing, lodging and other necessities, payment for the same.
   The rest and residue of ready money, securities for money, debts owed on bonds, bills, mortgage, judgements and all other debts, credits, rings, plate, linen, stock, corn, hay and personal estate (his debts, funeral and probate costs, first paid), to his two sons, William and Thomas, equally shared, for ever. William is sole executor. The guardianship and education of son Thomas, will be in the hands of brother in law, John Banks of Sittingbourne, Grocer and, testator wants him to make an inventory of his personal estate. Banks to be reimbursed by son William.

Benjamin TROWTE 1623

This tomb, which has no surviving inscription, is reputed to be the
tomb of Benjamin Trowte, who died in 1623, this monument
certainly fits this period. However, his will has survived.

Although this concise version which is taken from the registered copy, which was entered into a large book, in 1623 and is in very good condition, I have had difficulty reading some personal and place names, for which I apologise.
Benjamin Trowte of Upchurch.
He is sick in body.
   He gives the house he now lives in, with orchard and garden, to his wife, Joane, for life and after her death, the house goes to Thomas Pett, his brother (in law?), for ever.
   His other house near Emsand? Forstal and two orchards there belonging, also to Thomas Pett, for the lifetime of testator's wife, Joane, Pett to pay the latter, 20 shillings per annum . If he does not pay, the executors can let the house to produce to 20 shillings per annum.
   He gives 20 acres of land by Church ( ? ), which he bought from S( ? ) Lydgan and Joane his wife, to Thomas Pett and his brother William Pett, equally shared, for their lives. They are to pay from this land, 10 shillings per annum to Rebecca Foule or Fowle his niece and after her death, to Alexander Foule or Fowle, her son, for his life, he paying for ( ? ) years in five dozen loaves for the poor of Upchurch. The bread to be distributed in the church porch, by the Minister, Churchwardens and Overseers, on Maundy Thursday and the Saturday before Michaelmas.
   He gives his half of a salt marsh with the privileges, called Slingfield? , to William Pett for the term left on the lease.
   To Thomas Pett, his best hat and breeches; to William Pett, his g??mans coat and rest of his apparel.
   His clock?, with all furniture belonging, to William Bownes?
   To each of his God children, Mary Pett, Joane Billarowe?, and Alice Coule?, a ewe at Michaelmas next after his death, at the discretion of his executors. To Rebecca Foule of Fowle, ten ewes at Michaelmas, next after his death.
   He desires Thomas Pett to pay 40 shillings and William Pett to contribute money from land he has been given to purchase a large tomb stone to ( ? ) his son and himself to be placed on his grave within 2 or 3 years of his death.
   He gives Thomas Pett 12 bushels of ( ? ) to be delivered to him with 3 months of his death.
   His bedstead and furniture in his chamber and table and forms in the hall and two chests in in his chamber remain in the house after his death.

   To the child she is now pregnant with, either male or female, £100 at the age of 21. Concerning the education of that child, his executor is to allow his wife, £5 and bring it up until it is 14. His executor can take the child away, " if it be not well used".
   To the poor of the parish of Upchurch, 10 shillings, to be distributed by his executor, who is his brother, Richard, at his discretion on the day of his burial. His father, John, is to be overseer of the will.
